What is ‘legally drunk’ in Kansas?

For drivers under 21 years, the state considers them legally drunk when their blood alcohol level is more than .02, for non-commercial drivers above 21 years; they are legally drunk when their blood alcohol level is more than.08. On the other hand, commercial vehicle drivers are considers legally drunk when their blood alcohol level is more than .04

Kansas Drunk Driving Penalties

First time DUI offenders face the following penalties when convicted:

  • A prison sentence of 2 days to 6 months
  • A fine ranging from $750 to $1,000
  • The offender must serve at least 48 consecutive hours of imprisonment or 100 hours of community service
  • The offender is required to enroll in,  and complete an alcohol safety education  program or treatment program
  • The suspension period for the offender’s driver’s license is one month
  • After the suspension, the offender will be required to drive on a restricted license for 330 days
  • Depending on the circumstances surrounding the conviction, the judge will determine what restrictions the offender should adhere to.

Punishments for second time offender include:

  • A prison sentence of 3 months to 1 year
  • A fine ranging from $1,250 to $1,750
  • The offender must serve a minimum of 5 days in prison
  • The offender is required to enroll in,  and complete, an alcohol safety education  program or treatment program
  • The suspension period for the offender’s driver’s license is one year
  • After the suspension period the offender will be required to equip all vehicles that he/she uses with an ignition interlock device for a period of 1 year.

Offender convicted for a third time face the following penalties:

  • A prison sentence of 3 months to 1 year
  • A fine between $1,750 and $2,500
  • The offender must serve at least 3 months in prison
  • The driver’s license suspension period is 1 year
  • The offender will be required to equip all the vehicles he/she uses with an ignition interlock device for a period of 1 year.

 
For a fourth or subsequent conviction the offender faces:

  • A prison sentence of 3 months to 1 year
  • A fine of $2,500
  • The offender must serve 3 months in prison
  • The driver’s license suspension period is 1 year
  • The offender will be required to equip all the vehicles he/she uses with an ignition interlock device for a period of 1 year.

 

The Point System in Kansas

Kansas does not use the point system. Too many offenses and violation in Kansas will lead to action by the DMV. Expect cancellations, revocations, or suspensions of your license and registration.
