What is ‘legally drunk’ in Maine

In Maine, for driver under the age of 21 years, there is no legal drinking limit, they are consider to be legally drunk when their blood alcohol level is more than zero. For non-commercial driver above 21 years, the state considers them to be legally drunk when their blood alcohol level is more than .08. However, for commercial vehicle drivers, they are legally drunk when their blood alcohol level is more than .04.

Maine Drunk Driving Penalties

For first time DUI offenders in Maine they face the following penalties:
 

  • A prison sentence of up to one year
  • A fine ranging between $500 and $2,000
  • The revocation period for the offender’s driver’s license is 3 months
  • Imprisonment for at least two days is mandatory if:

 

  • The offender’s BAC was more than .15
  • The offender was exceeding the recommended speed limit (30 mile per hour)
  • The offender attempted to elude the police
  • If at the time of the offence the offender had a passenger who is less than 21 years

For second time offenders within ten years of the previous conviction, they face:

  • A jail term of up to one year , the offender must serve a prison sentence of at least 7 days
  • A fine ranging between $700 and $2,000
  • The offender will be required to participate in an alcohol program.

 
For third time offenders within 10 years of the previous conviction, they face the following penalties:

  • A prison sentence not exceeding five years, the offender must serve at least 30 days in prison
  • A fine ranging between $1,100 and $5,100
  • The driver’s license suspension period is 4 years
  • The offender will be required to take part in an alcohol program

 
For a fourth time offender, he/she faces:

  • A prison sentence not exceeding five years, the offender must serve at least 6 months of the  sentence
  • A fine of $2,100 and  to $5,100
  • The driver’s license suspension period is six years.
  • The offender will be required to participate in an alcohol program.

 

The Point System in Maine

Every time you are convicted of a traffic violation, points are placed against your Maine driver’s license. The seriousness of the offence determines the points you will get.
 

  • Exceeding the maximum speed limit by less than15 mph :6 points
  • Exceeding the maximum speed limit by 15-30 mph:6 point
